CADC has partnered with a coalition of groups to stop the nomination of Kagan. Here is a letter we recently sent individually to each of the Senators from the Judiciary Committee.

Dear Senator ________:

President Obama has nominated Solicitor General Elena Kagan to serve on the United States Supreme Court.  There are a host of reasons why you should vote against Elena Kagan, and many of the below signers have already communicated those reasons to you. Our purpose in this letter is to communicate with you on an issue that is so fundamental to our American legal system that it alone compels our joint request that you vote against her confirmation.

At her nomination hearing, in an exchange with Senator Tom Coburn, Kagan refused to say what natural rights she believes superseded and exist independent of the Constitution. Moreover, she refused to embrace the affirmation of the Declaration of Independence that "all men are created equal, that they are endowed by their Creator with certain unalienable rights that among these are Life, Liberty and the pursuit of Happiness."

In so doing, Elena Kagan has disavowed the very principles on which this nation was founded, and opted instead for a theory of conditional rights based on the whims of the governing elite. As the Founding Fathers understood, natural law recognizes that certain rights inure to Man by his nature - a nature bestowed on him by God - and that, by the application of reason, we may know these rights. It's really quite simple: either you believe that human rights are absolute or you do not. Either you believe that government must respect these rights - but cannot create, abolish, or alter them - or you do not. In each instance, Kagan does not.

Elena Kagan sides with the great tyrants of history and against the Founding Fathers.  Therefore, by her own admission, she is uniquely unfit to serve on the United States Supreme Court. To keep faith with your oath to protect and defend the Constitution, we respectfully request that you vote against her confirmation to the United States Supreme Court.
